We value our customers and take their security seriously.

We do not store credit card details, nor do we share customer details with any third parties other than with the courier when you book a delivery.

If you buy from us, or if you sign up to our mailing list or social circle, we will not bother you with endless emails but will send occasional vineyard updates, wine news and delightful offers.

If you do not wish to hear from us anymore, you may unsubscribe from them at any time.

By using this Website you consent to the collection and use of information provided for the purposes of processing enquiries and orders and contacting you in respect of the provision of our (and our affiliated companies) goods and services, as detailed on this Website.

Information requested about you, e.g. your name, postal address, telephone number and email address, is requested to enable Lakestreet Vineyard LLP and its related companies: Sussex Vineyards Ltd, Mayfield Vineyards Ltd, and Hobdens Vineyards LLP, to process any orders you make, and to contact you regarding details of our goods and services. The information may also occasionally be used to inform you about changes in the goods and services any of our wholly owned companies provide.

If we change our Privacy statement we will post the changes on this page, and may place notices on other pages of the Website, so that you may be aware of the information we collect and how we use it at all times. Continued use of the Website will signify that you agree to any such changes.

Sales Policy

Please read this section carefully before placing your order. We recommend you keep a copy for future reference.

Contract

These terms and conditions of sale comprise all the terms of the contract between us for the goods described in the Website and communicated to us electronically by you.

The goods supplied from the Website are supplied by Lakestreet Vineyard LLP VAT Registration No: GB 993 8156 67, Registered Company No: OC354574, registered at 8 High Street, Heathfield, East Sussex TN21 8LS.

Wines bought from this website must be paid for before delivery by electronic funds transfer (BACs) into the specified company bank account. Details for payment will be provided on your invoice. Credit and debit cards are not accepted at this time.

We may amend these terms from time to time by placing appropriate notification on this page.

If you make any input errors during the placing of your order you will be given the opportunity to check that your details are accurate before you submit your details. It is your responsibility to check that your order is accurate and to supply all relevant information accurately which is necessary to complete the order requested.

We must receive payment of the whole of the price for the goods that you order before your order can be accepted.

Once your payment has been received by us, we will confirm that your order has been accepted by sending an email to you at the email address you provide when contacting us to place an order.

Our acceptance of your order brings into existence a legally binding contract between us.

Restrictions

We cannot sell alcohol to anyone under the age of 18. When placing an order you will be required to confirm that you are at least 18 years old and that you are not buying alcohol for someone who is under 18 years old.

We ask that you ensure that there is someone available at the designated delivery address who is aged 18+  to sign for and take delivery from the Courier.

Prices and Delivery

Wines are offered subject to availability. We reserve that right to alter prices.

The prices payable for goods that you order are as advised by email prior to your purchase. All prices are in UK Sterling and are inclusive of Value Added Tax or Agricultural Flat Rate as appropriate and unless otherwise specified.

Delivery charges to most locations on the UK mainland, excluding those listed below are £8.50 for up to one case (6 bottles of wine) and a further £8.50 for each additional full case, or part thereof unless otherwise advised. Delivery to some rural areas of Scotland may not be possible by courier. If this is the case we will quote you alternatives if they are available to us prior to confirming your order.

Delivery charges to European Union (EU) or European Free Trade Area (EFTA) countries will be quoted to you in advance of your purchase and will be dependant upon your location.

 

Cancellation by you

You may cancel your contract with us for the goods you order at any time up to fourteen days from the date you receive the ordered goods, provided the bottles are not opened and the seals on the bottles are not broken. The goods must then be returned to us intact within 14 days of your notifying us of your cancellation. If you wish to return your order to us we reserve the right to charge you for the delivery service. Goods must be returned to us in the same condition as they left us and at your own cost and risk. If you wish to return goods due to cancellation of your order we ask that you do not unpack them upon arrival at your address. Please send them back in the same condition as they arrived with you. All goods must be returned in their original condition and wrapping, therefore please take care when unpacking goods and repacking.

You cannot cancel your contract if:
 the goods you have ordered have been made specifically to your order from their generic form; the goods have been opened by you; or the goods have been altered or damaged by you in any way.

To cancel your contract you must notify us in writing by email or post. If you cannot find our email address for any reason, please use the “Contact us” form on this website or telephone 01435 87 27 62.

Cancellation by us

We reserve the right to cancel the contract between us if: we have insufficient stock to deliver the goods you have ordered or we do not deliver to your area; or
 one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

If we do cancel your contract we will notify you by email and will re-credit to your account any sum received by us your bank account as soon as possible but in any event within 30 days of your order.

We will not be obliged to offer any additional compensation for disappointment suffered.

 Whilst we will endeavour to ensure that our communication with you reflects actual stock levels, there is a possibility of an item becoming unavailable before we are able to process your order. In such a case, we will offer a substitute that we feel is a suitable item of equal or greater value. In the event that we need to do this, we will contact you to discuss the substitution of an alternative product with you.

If we are unable to agree on a suitable substitution then you will have the option to either modify your order, or to cancel your order and receive a full refund.

 

 

Returns Policy

If you are unhappy with the quality of any of our wines please return them, with proof of purchase to the company from whom you purchased them.

All goods must be returned in their original condition and wrapping, therefore please take care when unpacking goods and repacking.

Once you have notified us that you are cancelling your contract, any sum paid to by bank transfer will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

Delivery of goods to you

We prefer to arrange delivery on a Tuesday to Friday basis so that our wine does not sit in hot warehouses over the weekend.  Where possible we will try to accommodate your preference for delivery date. Delivery on Saturdays is available at an extra cost. Saturday delivery costs will be quoted to you prior to purchase if required.  Generally wine will be dispatched within three days of our receiving your payment in full. You will be notified by email from the Courier that your wine is on the way.

We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order. To expedite delivery we will ask you for a contact phone number at the delivery address, the full postal address including postcode and a contact email address for the recipient of the goods.

Please note that at those times of the year when high volumes of orders are being placed, e.g. Christmas, Easter etc., we cannot always guarantee delivery within the usual timeframe as we are dependant on the courier.

Our courier will normally deliver between 8am and 4pm, Monday to Friday. If you are not at the delivery address at the time the Courier calls, the Courier will only leave wine in a safe place if you have given us specific instructions to do so prior to despatch.

You will become the owner of the goods you have ordered when we have received payment in full for the goods and they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss, damage or destruction.

Product Quality

Please note we do not filter our wines so, occasionally, some small flecks of grape skin or clear tartrate crystals may form in the wine. Both are entirely natural and will not affect your enjoyment of our wines.

Specification and Liability

The images, digital copies, descriptive matter and specifications of the goods contained on the Website are posted for the sole purpose of giving an approximate idea of the goods and you acknowledge that there may be slight differences. They will not form part of this Contract.

If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our contact address or by email of the problem within 2 days of the delivery of the goods in question.

If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the goods.

If you notify a problem to us under this clause, our only obligation will be, at your option:

  1. To make good any shortage or non-delivery,
  2. To replace or repair any goods that are damaged or defective subject to availability
  3. OR to refund to you the amount paid by you for the goods in question in whatever way we choose.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this Clause and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question as specified above.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our Website.

The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

Notwithstanding the foregoing, nothing in these Terms and Conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

 

 

events beyond our control

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, failure of ISP or telecommunications provider, war, riot, civil commotion, malicious damage, compliance with any law or government order, rule, regulations or direction, flood, fire, storm, act of God, explosion or accident, or acts of terrorism.

Notices

Unless otherwise expressly stated in these Terms and Conditions, all notices from you to us must be in writing and sent to our contact address Lakestreet Vineyard LLP, Hobdens, Wellbrook Hill, Mayfield, East Sussex TN20 6HH and all notices from us to you will be displayed on our Website from to time.

Invalidity

If any part of these Terms and Conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these Conditions will not be affected.

Intellectual Property Rights

All of the copyright in the products and designs, material, documents, site design, graphics, systems, codes and connections contained on our Website or linked to it and the selection and arrangement thereof are owned by or licensed to us, the Website designers or the publishers of those sites to which this Website links. All rights are reserved. You are entitled to electronically copy and to print in hard copy sections of this Website for the sole purpose of placing an order with us or for viewing our product range and not for any other purpose. Any other use of material on this Website, including photocopying, modifying and/or distributing any pages printed off this Website for the purposes other than those noted above, without our prior written consent, is strictly prohibited.

Third party rights

Except for our affiliates, directors, employees or representatives, a person who is not a party to these Terms and Conditions has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

The Contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have exclusive jurisdiction to resolve any disputes between us.

Entire agreement

These Terms and Conditions, together with our current Website prices, delivery details, Terms of Use Policy, contact details and our privacy policy set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these Terms and Conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

Complaints

If you are unhappy with any aspect of our service to you, please do not hesitate to contact us by email  or by post or by telephone : 01435 87 27 62.  If you have a justified complaint regarding wine supplied by us to you then you will need to retain the affected bottles and have these available to return to us if requested before a refund or replacement can be made in which case the collection and replacement costs will be borne by Lakestreet Vineyard LLP. We will respond to any complaints as soon as possible and will endeavour to resolve most issues within 2 working days. We will keep you informed of progress until a satisfactory resolution has been reached.
